Who we are

Loud Link is operated by Loud Limited (trading as Loud Beings), a company registered in England and Wales under company number 11324023, whose registered office is at 85 Great Portland Street, London, W1W 7LT.

For the limited technical and analytics data we collect to run and improve this site, Loud Limited is the data controller. Where you sign up to a mailing list, the artist, label or other client named on the form is the controller and we act as their processor (see “Mailing lists and marketing communications” below). Information we collect and how we use it

When you visit this website we collect limited technical data to understand and improve its performance. Some of this data may constitute personal data under data protection law. This includes:

• Approximate location, derived from your IP address
• The number of times the site is accessed
• Device information (e.g. type of device, operating system)

Purpose of data collection

This data is collected to measure activity on the site and to improve its performance, ensuring we provide the best possible user experience.

Personal information you provide

You do not need to create an account or give us any personal details to browse this site. If you choose to opt in for marketing communications (detailed below), we collect limited personal information, such as your name and email address, for that purpose only.

Lawful basis and retention

We rely on the following lawful bases for processing personal data, and keep it for no longer than necessary:

Mailing lists and marketing communications

In some places on this site, usually alongside a specific release, artist or campaign, you may be offered the option to sign up to a mailing list. That list belongs to the artist, label or other client whose page you are on. The client is the data controller of the information you submit: your details flow into their account, may be exported to or ingested into their own systems, and are used by them under their own privacy notice. We act as their processor: we collect, store and deliver the data on their instructions and do not use it for our own purposes.

Where that option is offered:

• The list owner is always named at the point you sign up. We will never ask you to hand your details to an unnamed or unspecified organisation. You will see who you are signing up to hear from in the form itself.
• Signing up is always optional, and never a condition of access to any content on this site.
• We collect only what is necessary: your name, your email address, the date and wording of the consent you gave, and the campaign it related to.

We do not pass your details to anyone else for marketing. Loud Link does not share personal data with third parties for those parties' own marketing purposes. If that were ever to change, the recipient would be named at the point you opt in and listed on our Partner Register, which forms part of this policy and is currently empty.

Withdrawing consent. You can withdraw at any time. Use the unsubscribe link in any marketing email, or contact the list owner named on the form. You can also contact us at [email protected] and we will pass your request to the controller concerned. Withdrawal does not affect the lawfulness of anything done before you withdrew.

Data sharing

Anonymous data

Performance metrics derived from anonymised data may be shared with our service providers and clients to help improve our services. This data cannot be used to identify you personally.

Personal data

We share personal data in three circumstances only:

• With service providers acting on our instructions: hosting, email delivery, analytics, security and support. These providers act only on our documented instructions, are bound by written contracts, and may not use your data for their own purposes. The current list is on our Sub-processors page.
• With the artist, label or other client whose page you signed up on: that client is the controller of the personal data collected through its pages, and we deliver it to them (for example by export, or ingestion into their own CRM) as their processor.
• Where we are required to by law, or where it is necessary to establish, exercise or defend legal claims, or to protect the rights, property or safety of any person.

We do not sell your personal data. We do not share it with any third party for that third party's own marketing purposes.

Where a release page or artist page on this site is operated on behalf of a label, artist or other client, that client is the controller of personal data collected through it and we act as their processor. The relevant client is identified on the page concerned.

International transfers

Some of the service providers we rely on are based outside the United Kingdom and the European Economic Area (EEA), including in the United States. This means personal data such as your approximate location and device data, and, where you have opted in to a mailing list, your name and email address, may be transferred to and processed in those countries. The providers we use and the countries they operate in are listed on our Sub-processors page.

Wherever personal data leaves the UK or the EEA, we make sure it stays protected by an approved safeguard. Depending on the provider, this is one of the following:

• the UK International Data Transfer Agreement (IDTA), or the UK Addendum to the European Commission's Standard Contractual Clauses, for transfers from the United Kingdom;
• the European Commission's Standard Contractual Clauses, for transfers from the EEA; or
• the recipient's certification under the EU-US Data Privacy Framework and its UK Extension (the UK-US “data bridge”), where that applies.

Security

We use industry-standard security measures to prevent the loss, misuse, or alteration of any data under our control. Where personal data (such as your name and email address) is collected through an opt-in, it will be stored securely and retained only for as long as necessary to fulfil the purpose for which it was collected or as required by applicable law.

United Kingdom and European Union

If you are in the UK or the EU, you have the following rights under the UK GDPR and the EU GDPR:

• Right to erasure: You can request deletion of your data under certain conditions.
• Right to restrict processing: You can request restrictions on the processing of your personal data.
• Right to data portability: You have the right to request that your data be transferred to another organisation or directly to you.
• Right to object: You can object to the processing of your data under certain conditions.

California residents

Pursuant to the California Consumer Privacy Act (CCPA), California residents have the right to:

• Know: Request disclosure of our data collection and sales practices in relation to your personal information, including the categories of personal information we collect, the source of the information, use, and, if applicable, who we share it with.
• Request deletion: Ask for deletion of your personal information (with certain exceptions).
• Opt out of sales: Direct a business to cease the selling of your personal information.
• Non-discrimination: Receive equal service and price, even if you exercise your rights under the CCPA.

We do not sell or share your personal information as those terms are defined under the CCPA/CPRA. Personal information collected through signup forms on this site is collected on behalf of the artist, label or other client named on the form; we act as that client's service provider and disclose the information only to that client and to the service providers listed on our Sub-processors page. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Right to complain

You also have the right to lodge a complaint with a data protection supervisory authority. In the UK this is the Information Commissioner's Office (ICO), ico.org.uk. If you are in the European Union, you may complain to the supervisory authority in your country of residence.

Age restrictions

We are committed to protecting the safety and privacy of young people using the internet. While our website is suitable for users of all ages, we strongly advise children under the age of 13 to obtain consent from a parent or guardian before accessing or using our site.

Parents and guardians should be aware of and help enforce their children's online privacy. We encourage parents and guardians to spend time online with their children and to be familiar with the sites their children visit.

If you are a parent or guardian and believe ‘Loud Link’ might have inadvertently collected information from your child under the age of 13, please contact us immediately, and we will use our best efforts to promptly remove such information from our records.
